The Senate Choked on the CLARITY Act

A 49–50 procedural defeat leaves Washington without a market-structure bill—and the status quo untouched.

The bill dies at the gate

Well, well, well—the Senate choked on the CLARITY Act again, 49–50, and every Democrat plus a handful of squeamish Republicans—Collins, Hawley, Moran, and Tillis, for procedural reasons—killed it dead in the water. Cynthia Lummis stood up and basically read it its last rites. “It’s over,” she said, and she’d know, since she’s been carrying this bill on her back for years.

Bitcoin still doesn’t need permission

Now here’s the part that gets my dentures rattling: Bitcoin doesn’t care about your Senate procedure. It never has. Bitcoin’s value comes from scarcity, adoption, and a fixed monetary policy nobody in Washington can filibuster—not from whether 535 people in expensive suits agree on how to regulate exchanges and stablecoins. The CLARITY Act was about market structure—dividing turf between the Securities and Exchange Commission and the Commodity Futures Trading Commission, and setting registration rules—not about whether Bitcoin itself is worth owning.

“Sound money doesn’t need a permission slip from Congress, kids.”

It’s been surviving without one since 2009.

The ethics fight had a backward result

But let’s talk about the real punchline here. The Democrats tanked this bill specifically because they wanted tougher ethics and divestment rules to stop Trump and his family from cashing in on crypto while he’s in office—his family reportedly hauled in over $1.4 billion from crypto ventures last year, with more than $500 million of that from World Liberty Financial alone. And there’s fresh reporting today that WLFI tokens tied to Trump are sitting in a vesting contract that unlocks starting in May 2028—a two-year cliff, then a slow drip.

The status quo is the real winner

So by blocking the bill meant to rein that in, the Democrats didn’t stop the gravy train—they just left the tracks exactly as they were. No CLARITY Act means no new federal guardrails, no divestment requirements, no blind-trust mandates—just the status quo, which happens to be wide open for the First Family to keep making money hand over fist from crypto.

That’s not a win for ethics, folks. That’s shooting yourself in the foot to spite your face. If you wanted to actually slow down the family business, you needed the law on the books—not a stalemate that changes nothing. Sometimes the “principled stand” just means everybody loses except the people you were trying to stop. Dumb move indeed.
